Online/Distance State Authorization Process

The United States Department of Education regulation 4 C.F.R.§ 600.9(c) requires each state to apply for and receive authorization to provide online/distance education programs to out-of-state students. The authorization requirements, as well the application processes, vary on a state-by-state basis. The Distance & Continuing Education (DCE) department works with faculty and staff across all colleges and departments within the University of Florida who have or may establish online programs to comply with this regulation. In addition, distance education programs in allied health professions, counseling, education, nursing, social work, and veterinary medicine may require additional approval from state licensing agencies or boards. Out-of-state students who are considering applying to a professional program should contact the licensing agency or board in their state prior to enrollment. The University of Florida cannot attest to whether a program meets licensure requirements in a student's state of residence. 

DCE also works to support the National Council for State Authorization Reciprocity Agreements (NC-SARA) in identifying and updating an index of state legislation and application requirements. If adopted, SARA would establish standards for reciprocity agreements that colleges and universities from around the country would have to meet, but provide the advantage of a singular application to provide online/distance education in all 50 states. Currently, Florida is NOT a SARA state, but will continue to seek authorization to ensure compliance. 

The University of Florida (UF) is accredited through the Southern Association of Colleges and Schools Commission on Colleges (SACSCOC). SACSCOC is an institutional accrediting agency recognized by the U.S. Department of Education. This federally-recognized body provides assurance to students, parents and all stakeholders that UF meets clear quality standards for educational and financial performance. In addition, UF is required by the U.S. Department of Education to provide all current and prospective students with the contact information for their respective state agency in the event they wish to file a complaint. Each online distance learning program has a process for, and will make every attempt to resolve, student complaints within its academic and administrative departments at the program level. If an issue cannot be resolved at the program level, students have the right to file a complaint with the Office of the Ombuds or the Office of the Associate Provost for IT. The University is required to provide both current and prospective students with contact information for filing complaints with its accrediting body, the appropriate state agency for handling complaints in a student's resident state, as well as the state portal agency (if the state is a member of SARA). Alabama (NC-SARA Member)

The University of Florida (UF) has received a Certificate of Approval by the Alabama Commission on Higher Education. Prospective students living in Alabama are able to enroll in over 175 online programs. Please visit the following link for a full List of Approved Programs. In addition, UF has also received a Certificate of Exemption from the State of Alabama’s Department of Postsecondary Education. The Alabama Commission on Higher Education requires UF to provide the following disclaimer for Educator Preparation and Nursing programs:

Educator Preparation Programs: “State authorization to provide a program related to the preparation of teachers or other P-12 school/system personnel does not indicate eligibility for an Alabama certificate. Applicants who complete an educator preparation program at an institution outside of Alabama must apply for an Alabama professional educator or professional leadership certificate through the Alabama Certificate Reciprocity Approach. Current requirements may be found at www.alsde.edu"  

Nursing: "State approval of a program to offer Alabama licensed nurses opportunities for advanced degrees does not indicate eligibility for approval to practice as an advanced practice nurse in Alabama. Applicants for approval in Alabama are required to meet the Alabama requirements for national certification, graduation from a specific-type of program for the advanced practice approval, and completion of the appropriate application. Any program offering a pre-licensure track to Alabama students shall meet the requirements of the Alabama regulation for pre-licensure programs or the graduates may not be eligible to take the national licensure examination required by the Alabama Board of Nursing to enter the practice. www.abn.alabama.gov"

Alaska (NC-SARA Member)

All fully online programs are exempt. However, programs that meet the “Physical Presence” defined as “an entity offers credit-bearing courses from or conducts some portion of the learning experience at a location established in New Jersey by the entity, whether established directly or under the auspices of another entity or an institution.” N.J.A.C. 9A:1-1.2. In addition, any program that requires a clinical or internship component for a certain degree, must meet the following criteria that: 1) The student-supervisor relationship is conducted on a one-to-one basis (e.g. no group review sessions or other gatherings); and 2) The supervisor is not a permanent employee of the institution.
